By accessing or using PuntList.com ("the Platform"), operated by PuntList LLC, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
PuntList is a professional client review platform that allows registered business professionals to search for and submit reviews about clients they have worked with. All reviews are subject to AI-powered moderation for legal compliance, factual accuracy, and adherence to our Review Guidelines. PuntList does not guarantee the accuracy, completeness, or reliability of any user-submitted content.
You must be at least 18 years old and a legitimate business professional to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials. Each person may only maintain one account. We reserve the right to suspend or terminate accounts that violate these Terms.
By submitting a review, you represent and warrant that: (a) you have had a genuine professional relationship with the client being reviewed; (b) the information in your review is truthful and based on your firsthand experience; (c) your review does not contain defamatory, libelous, or knowingly false statements; (d) your review complies with our Review Guidelines. You retain ownership of your content but grant PuntList a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the Platform.
All reviews are analyzed by our AI moderation system before publication. This system checks for potential defamation, libel, slander, and other legal risks. PuntList reserves the right to reject, modify, flag, or remove any review that our moderation system or human reviewers determine violates these Terms or our Review Guidelines. AI moderation is not a guarantee of legal compliance — reviewers remain solely responsible for the content of their reviews.
Clients who are the subject of a review may submit a formal dispute through our dispute process. PuntList will review disputes and may take action including requesting additional evidence, flagging reviews for further investigation, or removing reviews found to violate our guidelines. PuntList acts as a neutral platform and does not adjudicate the underlying business disputes between parties. Decisions on disputes are made at PuntList's sole discretion and are final.
You agree not to: (a) submit false, misleading, or fraudulent reviews; (b) review a client with whom you have not had a genuine professional relationship; (c) use the Platform to harass, threaten, or intimidate any person; (d) manipulate ratings through fake accounts, coordinated reviews, or other schemes; (e) attempt to circumvent our AI moderation system; (f) scrape, crawl, or use automated means to access the Platform without written permission; (g) use the Platform for any illegal purpose; (h) impersonate another person or business.
PuntList offers both free and paid tiers of service. Paid services are billed through our payment processor, Stripe. All fees are non-refundable unless otherwise stated. PuntList reserves the right to change pricing at any time with 30 days' notice to active subscribers. Subscription cancellations take effect at the end of the current billing period.
PuntList is provided "as is" and "as available" without warranties of any kind, either express or implied. PuntList LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to PuntList in the twelve months preceding the claim. PuntList is not responsible for the accuracy of user-submitted reviews or any decisions made based on information found on the Platform.
You agree to indemnify, defend, and hold harmless PuntList LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, your submitted content, or your violation of these Terms.
The PuntList name, logo, and all related marks, designs, and content created by PuntList are the property of PuntList LLC. You may not use our trademarks without prior written consent. All software, design, and technology underlying the Platform are protected by intellectual property laws.
We may terminate or suspend your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
